General terms and conditions and scope of application
These terms and conditions regulate the contractual relationship between ARGE Ostalpen, consisting of the lift companies stated at the end of these terms and conditions (hereinafter referred to as “Member Companies”) and the natural persons (hereinafter referred to as “Customer or Proprietor”) who purchase the Ostalpen-Card. The customer shall explicitly accept these terms and conditions by purchasing and using the Ostalpen-Card.

1. Entitlement to purchase and use of the Ostalpen-Card

  • All persons shall have the right to purchase the Ostalpen-Card. They shall receive the normal rate according to the price list. Members of the Landesskiverband of Lower Austria, Styria, Vienna, Burgenland and Upper Austria shall receive the Skiverband rate on production of a valid ÖSV Licence.
  • Children born in 2014 and after are free of charge according to the rate conditions of the individual ski resorts.
  • Persons born between 2005 and 2013 shall be considered children.
  • Persons born between 2001 and 2004 shall be considered teenagers.
  • Persons born between 1994 and 2000 shall be considered U25, only when purchasing the Ostalpen-Card at the regular price.
  • Persons with a degree of disability of 60% shall be considered disabled (on production of proof in the form of an original social security confirmation) and shall receive a special rate.
  • The Ostalpen-Card shall only be valid for one person and shall only be supplied on submission of a surname, first name, date of birth, address and photograph. The photograph, first name and surname shall be digitally imprinted on the applicable field in the cash system. A person must be present or must produce a recent photograph (without head cover or ski goggles) in order to purchase an Ostalpen-Card.   • The card cannot be transferred, even within a family.
  • Authorised photo ID must be carried and/or produced when purchasing and using the card.
  • The Ostalpen-Card shall only be installed on contactless data carriers. A keycard costs a deposit of 2.00 euros. The functional ISO Dual Keycard can also be used the following year. If a keycard stops working, the data can be transferred onto another card. A sum of 2.00 euros must still be paid for the new card. The sum of 2.00 euros paid for the keycard will be returned to the customer when the data carrier is returned to the cash desk undamaged. In order to use the facilities provided with the Ostalpen-Card, the customer must always carry the Ostalpen-Card with them and show it on request, together with photo ID.

2. Purchase and return

  • The card may be purchased using the following methods:
  • Purchase of the card at the ski resort: The customer pays for and receives the desired Ostalpen-Card in a ski resort at a cash desk marked as authorised to sell the card.
  • Purchase of the card using the online order form: All personal details necessary for the issue of the card are collected using the online order form. On the completion of the order process the customer receives a summary of their order. This contains all information about payment and delivery. The payment must be transferred to the Hochkar Bergbahnen GmbH account, as they are the administrative agency for ARGE Ostalpen. The card will be sent to the customer immediately after the payment has arrived in this account. In general, the card is delivered within three working days.
  • Purchase of the card via e-mail to office@skiregion-ostalpen.at: Payment can take place via direct debit or advance bank transfer, according to the customer’s preference, after the personal details required for the issue of the card have been sent to the ARGE Ostalpen e-mail address. The card is sent out after payment has been received, as in previously stated points.
  • Customer’s withdrawal from the purchase is strictly excluded, as stated in Point 3. Special conditions are described in Point 7 Refunds.

3. Rates and liability

  • The rates fixed for the current season shall apply for the purchase of the Ostalpen-Card.
  • It shall not be possible to transfer to another ski pass, transfer the card to another person, or to move the card’s validity period.
  • The owner of the Ostalpen-Card shall be obliged to keep their keycard safe, so that third parties do not gain access to it and that misuse, loss and theft can be avoided.
  • There shall be no right to refund due to bad weather, departure or illness (for exceptions see Point 7), risk of avalanche, malfunction or operational interruptions to facilities, or slope closures.
  • The individual Member Companies shall each operate their respective cable car and lift facilities and slopes autonomously and on a legally independent basis. Purchase of an Ostalpen-Card shall enable the guest to use the Member Companies included, however the concrete service contract only takes place with the Member Company whose facilities are currently being used. Please therefore take note of the applicable rate and transport conditions in each ski resort. Any liability with regard to guests, whether due to contractual or legal provisions, for incidents arising from or during the operation and use of the cable car and lift facilities and slopes therefore applies exclusively to that Member Company into whose field of responsibility the incident falls. Liability of the other Member Companies shall be excluded. For facilities which lie in or adjacent to the Member Company, but which do not belong to the group that has signed the Ostalpen-Card Agreement, but in which the Ostalpen-Card is valid due to an internal pool constellation (Sub-partner), the Member Company in whose field of influence these facilities are located shall take on all obligations under liability law should the Sub-partner be unable to pay.
  • The right to discontinue individual facilities during or all facilities at the end of the season due to snow or weather conditions is reserved. In such a case there shall be no right to refund.

4. Terms of use
The owner of the Ostalpen-Card shall be entitled to make use of those facilities provided by the Member Companies which can also be used by purchasing a regular day pass during the opening and operating hours (excluding special trips outside of regular operating hours). The operating and opening hours shall be determined independently by each Member Company. There shall be no right to refund (including aliquot refunds) in the case of the (partial or full) closure of individual Member Companies, for whatever reason.

5. Loss/theft
In cases of loss or theft, the owner of the card shall be obliged to report this to a Member Company immediately so that the lost or stolen card may be locked. A notice of loss or theft must also be obtained from the authorities immediately. A new card shall be issued only once this notice or loss or theft is provided. This new card must be issued before the other card gets misused. A card may only be unlocked by an East Alps syndicate co-ordinator or a Member Company. There shall be a waiting period of one day for the verification and arrangement of the locking of the card. The customer shall be charged a 25.00 euros processing fee for the issue of the replacement card and 2.00 euros for the keycard.

6. Forgetting the Ostalpen-Card
Should the customer forget their Ostalpen-Card, they must pay the rate charged by the respective individual Member Company for the period of use. There is no right to a refund for the rate paid due to the forgotten card, even where a valid Ostalpen-Card is subsequently produced.

7. Refunds
In the case of accidents or illness which have a negative effect on a person’s health for a duration of at least five weeks, a refund shall be provided according to the calculation formula below. In order to receive a refund, the user must produce medical confirmation (in the case of accident or illness with the duration of negative effect). Until this medical confirmation is produced there shall be no right to a refund. The amount of the claim for a refund shall be determined on the basis of the time at which the Ostalpen-Card was deposited with the Member Company. The refund is always calculated on the basis of a seasonal validity period of 120 ski days. The refund is always calculated from 1 December to the end of February for the current ski season, regardless of the actual start of the season.

8. Misuse
All wrongful use of the Ostalpen-Card by the customer shall result in the immediate removal of the Ostalpen-Card. There shall be no right to a replacement. Misuse shall particularly refer to cases of (attempted) forwarding and use of the Ostalpen-Card to/by third parties, and purchase of the card by providing a false main place of residence, age, employment relationship etc., or if this was obtained on the provision of false evidence. In cases of misuse the customer shall further be obliged to pay a contractual penalty of 250.00 euros to the affected Member Company (that which discovered the misuse).The affected Member Company shall also reserve the right to press criminal charges.

9. Defective data carriers
Should an Ostalpen-Card data carrier (keycard) not be accepted at a turnstile although the card is valid according to the imprint, each Member Company shall issue a “new card” in the area in which the issue arose. The customer shall be charged a sum of 2.00 euros for the new keycard. 2.00 euros shall be returned to the customer for the defective but otherwise externally undamaged keycard. Should there be external damage, however, the 2.00 euros shall not be returned to the customer.

10. Compensation
Claims for compensation in cases of simple negligence are excluded. This shall not apply to personal injury. Otherwise the rate and transport conditions for the individual Member Companies shall apply.

11. Place of jurisdiction/applicable law
For all claims made due to disputes arising from this Contract against a consumer who is resident, ordinarily resident or has a place of employment within the same country, one of the courts shall be responsible in whose jurisdiction the consumer is resident, ordinarily resident or has a place of employment. For consumers who, when the contract is signed, are not resident in Austria, the legal jurisdictions shall apply. Austrian substantive law shall apply. The contractual language shall be German.

12. Change of address
In the case of a change of address, the customer shall be obliged to register the change of address within 14 days.
